Acceptance of Terms

By signing up for Spottr, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, you may not use the app.

No Tolerance for Objectionable Content

Spottr is committed to providing a safe and respectful community. We have zero tolerance for:

• Obscene, offensive, or inappropriate content
• Harassment, threats, or abusive behavior
• Spam or misleading information

Violation of these policies may result in content removal, account suspension, or permanent ban.

User Responsibilities

• You are responsible for all content you post.
• Do not post content that violates any laws or rights of others.

Content Ownership and Moderation

You retain ownership of your content. However, by posting, you grant Spottr a non-exclusive license to display and distribute your content within the app.

We reserve the right to:

• Remove content that violates these terms
• Take action against users who violate our policies

Reporting and Blocking

• Users can report objectionable content or abusive behavior.
• Users can block other users from interacting with them.

Termination

We may suspend or terminate your account for any violation of these terms without prior notice.

Changes to Terms

We reserve the right to update these terms at any time. Continued use of Spottr after changes means you accept the new terms.

Copyright Protection

All content, features, and functionality of Spottr, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Spottr and are protected by international copyright laws.

Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our app without prior written consent from Spottr.

Any unauthorized use of Spottr's copyrighted materials may result in legal action and termination of your account.

Audio Content and DMCA Compliance

Users are strictly prohibited from uploading, sharing, or distributing any audio content that infringes upon third-party copyrights, including but not limited to music, sound recordings, or other copyrighted audio materials.

Spottr complies with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices. If you believe your copyrighted work has been used without authorization, please contact us at support@tryspottr.com with the following information:

• A description of the copyrighted work
• The location of the allegedly infringing material
• Your contact information
• A statement of good faith belief
• A statement under penalty of perjury

Users who repeatedly infringe copyrights may have their accounts terminated.

Roads, Racing, and Route Features - Liability Disclaimer

IMPORTANT: By using Spottr's roads, racing, route recording, leaderboards, and related features, you acknowledge and agree to the following liability disclaimers:

SPOTTR IS NOT LIABLE FOR ANY ACCIDENTS, INJURIES, DAMAGES, OR LOSSES that may occur while using our driving and racing features. This includes but is not limited to:

• Vehicle accidents, collisions, or damage
• Personal injury or death
• Property damage to vehicles, roads, or other property
• Traffic violations or legal consequences
• Financial losses related to driving activities

You are solely responsible for:

• Operating your vehicle safely and legally
• Complying with all traffic laws and regulations
• Maintaining proper vehicle condition and insurance
• Assessing road and weather conditions
• Your own safety and the safety of others

Spottr provides route information, leaderboards, and tracking features for entertainment and community purposes only. We do not guarantee the accuracy of route data, weather information, or leaderboard rankings.

Racing and Competitive Features

Spottr's racing features, including leaderboards, spirited drives, and competitive timing, are provided for entertainment purposes only. We explicitly disclaim any responsibility for:

• Racing-related accidents or injuries
• Competitive driving that violates traffic laws
• Speed-related incidents or reckless driving
• Damage caused during competitive activities
• Legal consequences of racing or competitive driving

Users participating in racing features acknowledge that:

• Racing on public roads may be illegal in many jurisdictions
• Competitive driving can be dangerous
• They assume all risks associated with racing activities
• They will not hold Spottr responsible for racing-related incidents
• They will comply with all applicable laws and regulations

Route Recording and GPS Tracking

Spottr's route recording and GPS tracking features are provided as-is without warranties. We are not liable for:

• GPS inaccuracies or signal failures
• Route data errors or omissions
• Navigation mistakes or incorrect directions
• Battery drain or device issues
• Data loss or corruption
• Privacy concerns related to location tracking

Users acknowledge that:

• GPS tracking may not always be accurate
• Route data is for entertainment purposes only
• They should not rely solely on Spottr for navigation
• They remain responsible for their own navigation decisions
• Location data may be shared with other users as part of the service

Weather and Environmental Data

Weather information provided by Spottr is for informational purposes only and should not be relied upon for driving decisions. We disclaim liability for:

• Inaccurate weather data or forecasts
• Driving decisions based on weather information
• Accidents or incidents related to weather conditions
• Changes in weather during driving activities

Users are responsible for:

• Checking official weather sources before driving
• Assessing current road and weather conditions
• Making safe driving decisions regardless of app data
• Adjusting driving behavior to actual conditions

Leaderboards and Community Features

Spottr's leaderboards and community features are for entertainment and social purposes only. We are not responsible for:

• Competitive pressure that may encourage unsafe driving
• Disputes between users over rankings or times
• Cheating or manipulation of leaderboard data
• Psychological effects of competitive features
• Community conflicts or disputes

Users acknowledge that:

• Leaderboard rankings are not official or authoritative
• Competitive features should not encourage unsafe behavior
• They will not engage in dangerous driving to improve rankings
• Community features are moderated but not guaranteed to be safe

General Release and Indemnification

By using Spottr's roads and racing features, you release Spottr, its officers, directors, employees, and agents from any and all claims, damages, losses, and expenses arising from your use of these features. You agree to indemnify and hold harmless Spottr from any claims brought by third parties related to your use of the app's driving features.

This liability disclaimer applies to all users, including premium subscribers, and cannot be waived or modified except in writing by Spottr.
